Conditions

 

Further to a review of the draft conditions cited in the Officer Report, the applicant has requested that the respective details required by condition nos. 8, 9, 10, 11 and 13 be revised in order to take account of the envisaged timetable for starting works on site. Although early works (commencement) would be expected around December 2025- subject to planning permission being granted-, main works are likely to take place around May 2026.

 

Therefore, the following changes are now proposed:

 

Condition 8 Drainage and Flooding Design

 

Development shall not commence until a scheme detailing foul and surface water drainage has been submitted to and approved in writing by the Local Planning Authority…

 

Replace with-

 

Prior to the commencement of above ground works and any drainage works, a scheme detailing foul and surface water drainage shall be submitted to and approved in writing by the Local Planning Authority…

 

Condition 9 Runoff rate, Storage Requirements and Maintenance

 

Development shall not commence until a scheme restricting the rate of development flow runoff from the site has been submitted to and approved in writing by the Local Planning Authority…

 

Replace with-

 

Prior to the commencement of above ground works and any drainage works, a scheme restricting the rate of development flow runoff from the site shall be submitted to and approved in writing by the Local Planning Authority…

 

Condition 10 Exceedance Flow Routes

 

No development shall take place until an appropriate Exceedance Flow Plan for the site has been submitted to and approved in writing by the Local Planning Authority…

Condition 11 Percolation testing required

 

The development shall not commence until percolation testing to determine soil infiltration rates are carried out and submitted to the LPA in writing for approval… …

Condition 13 Lighting (Ecology)

 

Within 6 months of commencement of development a “lighting design strategy for biodiversity” for the site shall be submitted to and approved in writing by the Local Planning Authority…

Additional Condition

 

Condition 22 Soil Movement

 

Prior to the removal of 150 cubic metres or more of soil/earth/waste from within the application site boundary, a Soil and Waste Removal Plan shall be submitted to and approved in writing by the Local Planning Authority. This shall include the cubic metres of soil and/or waste which is required to be removed from site together with a removal plan detailing the number of trips required, timing of the trips, highways route and vehicle type/size. There afterwards, the development will take place in complete accordance with the approved Soil Removal Plan.

 

Reason: To reduce impact to resident amenity and local road network.

Yorkshire Water

 

A further response has been received on behalf of Yorkshire Water, confirming they are satisfied that the development can proceed on the basis of the submitted plans, subject to recommended Condition 17 (Drainage Infrastructure and Landscaping).

 

Should any clarification on this be required as the development progresses, a site meeting can be arranged with the local Network Engineer Team to ensure the requirements of the condition are satisfied.
